摘要

近年来，我国的建筑工程市场不断发展，而工程法律风险是建筑工程的一个重要风险源。建筑工程的市场发展变化极大，但建筑工程法律风险依然存在于我们的生活中。在建筑工程过程中，如果没有有效防范并妥善解决其中的法律风险与道德风险，建筑工程将无法顺利进行，其施工质量将无法得到保障并且将导致工程质量无法达标且不利于工程顺利施工。为了解决建筑工程中法律与道德风险并存、建筑工程质量与道德风险并存的现象，提升建筑工程风险防范意识是当务之急。本文以工程的施工为例并对其法律风险及其防范措施进行分析，希望能给建筑行业从业人员带来一定思想启示和借鉴意义。由于工程施工领域有着很多的利益关系与不稳定因素出现，并且在工程实施过程中有很大可能存在着各种法律风险问题。所以就对工程施工过程中的风险进行分析具有重要意义。因此，从根本上分析这些法律风险并加以防范意义重大。

Abstract

In recent years, the construction engineering market in China has been developing continuously, and the legal risk of engineering is an important risk source of construction engineering. The market development of construction engineering has changed greatly, but the legal risk of construction engineering still exists in our life. In the process of construction project, if the legal and moral risks are not effectively prevented and properly solved, the construction project will not be able to proceed smoothly, the construction quality will not be guaranteed, and the project quality will not meet the standard and will not be conducive to the smooth construction of the project. In order to solve the coexistence of legal and moral risks, construction quality and moral risks in construction projects, it is urgent to enhance the awareness of risk prevention in construction projects. This paper takes the construction of a project as an example and analyzes its legal risks and preventive measures, hoping to bring some inspiration and reference to the practitioners of the construction industry. As there are many interests and unstable factors in the field of project construction, and there may be various legal risks in the process of project implementation. Therefore, it is of great significance to analyze the risks in the construction process. Therefore, it is of great significance to fundamentally analyze these legal risks and prevent them.
